ROMY WHOLESALE TERMS AND CONDITIONS

By placing an order via the ROMY Wholesale Portal, the Customer agrees to enter into a validly binding contract with ROMY (After Eight Pty Ltd, ABN 60 483 840 467) on the following terms and conditions in relation to the supply and payment of the goods selected through the portal (“the Goods”):

1. Legal Entity
By placing an online order, the Customer warrants they are a valid legal entity capable of entering into this contract.

2. Availability and Approval
All sales are subject to availability and, where applicable, prior account approval by ROMY.

3. Pricing
All prices on the portal are listed in Australian Dollars (AUD) and are inclusive of GST.

4. Payment Terms
ROMY wholesale operates on a pay-as-you-go model. Payment is due at the time of placing an order through the ROMY Wholesale Portal. Orders will not be processed or dispatched until full payment has been received. ROMY accepts credit card, AMEX, AfterPay and PayPal.

5. Cancellations and Changes
Orders are final once submitted via the portal. Because our goods are produced in limited runs with short lead times, ROMY does not accept cancellations, changes, or amendments after an order has been placed, unless otherwise agreed in writing.

6. Shipping and Delivery
ROMY ships from its Melbourne-based warehouse. Shipping rates are changed at a percentage of your total and will vary depending on the size of your order. ROMY ships via TMF or Standard Australia Post within Australia and Australia Post International for New Zealand.

7. Delivery Timing and Force Majeure
ROMY will use best efforts to dispatch orders received by midday on the day the order is received. If your order is placed after midday it will be dispatched the following business day. However, delivery dates are indicative only. ROMY is not liable for any delay and such delay does not entitle the Customer to cancel or vary an order. If delays are caused by circumstances beyond ROMY’s control (eg. natural disasters, shipping disruptions), ROMY will not be held liable and obligations will be suspended for the duration of the disruption.

8. Risk and Transit
Risk in the Goods passes to the Customer upon dispatch. ROMY is not liable for any damage, loss, or delay during transit. However, ROMY will assist in facilitating claims with third-party carriers if required. Please contact rochelle@romythebrand.com.

9. Faulty Goods
If any Goods are received damaged or defective, the Customer must notify ROMY in writing within 48 hours of delivery, providing relevant evidence and photographs. Faulty goods must be returned in original condition with tags attached. If confirmed faulty, ROMY will provide the return and offer replacement or credit.

10. Non-Faulty Goods
ROMY is not obliged to accept returns of non-faulty goods. All sales are final.
